Terms, Conditions, Disclosures & General Policies

Welcome to M&J Aguirre Inc. By booking, purchasing, renting, scheduling services, accessing our website, or engaging with M&J Aguirre Inc. (“Company,” “we,” “our,” or “us”), you acknowledge and agree to the following Terms and Conditions.

These Terms are intended to establish expectations, clarify responsibilities, and protect both the Company and its clients.

1. General Acceptance of Terms

By utilizing any service offered by M&J Aguirre Inc., including but not limited to vacation rentals, trailer rentals, equipment rentals, consulting, contractor coordination, transport support, custom modification services, hydrodipping, hospitality services, or related offerings, Client agrees to be legally bound by these Terms and Conditions.

If Client does not agree with these Terms, services may not be used.

Company reserves the right to update, revise, or modify these Terms at any time without prior notice.

2. No Warranty of Availability

All services are subject to:

  • Availability
  • Scheduling
  • Staffing
  • Equipment condition
  • Weather conditions
  • Property access
  • Vendor availability
  • Safety considerations
  • Regulatory restrictions

Submission of an inquiry or payment request does not guarantee booking or service approval.

Company reserves the right to decline or cancel services at its sole discretion.

3. Pricing & Estimates Disclosure

All pricing, estimates, proposals, quotations, packages, and verbal discussions are:

  • Preliminary in nature
  • Subject to change
  • Non-binding until formally accepted

Quoted pricing may change due to:

  • Material cost increases
  • Fuel costs
  • Labor availability
  • Vendor pricing
  • Supply chain issues
  • Scope changes
  • Market conditions
  • Taxes and government fees

Final invoices control.

Company does not guarantee pricing until confirmed in writing.

4. Payment Terms

Unless otherwise agreed:

  • Deposit may be required
  • Full payment due before service or occupancy
  • Accepted payment methods determined by Company
  • Returned payments subject to fees
  • Late balances may incur penalties

Failure to pay may result in:

  • Cancellation
  • Service suspension
  • Removal of access
  • Collection activity

Client responsible for collection costs and legal fees where permitted.

5. Cancellation & Refund Policy

Cancellation policies vary by division and booking type.

Unless otherwise stated:

Vacation Rentals

  • 30+ days: eligible for partial refund
  • Under 30 days: deposits may be non-refundable
  • Event or holiday reservations may be fully non-refundable

Rentals / Equipment

  • Same-day cancellations may forfeit deposits
  • No-shows may be charged

Consulting / Project Services

Time reserved is billable.

Refunds are discretionary unless required by law.

6. Vacation Rental Disclosure

Vacation rentals are privately managed accommodations.

Guests agree:

  • Occupancy limits must be followed
  • No unlawful activity
  • Respect neighbors and community rules
  • No property misuse
  • No unapproved parties or events
  • No damage or unsafe behavior

Guest responsible for:

  • Damages
  • Missing items
  • Excessive cleaning
  • Fines
  • HOA violations
  • Municipal violations

Security deposits may be withheld accordingly.

Company reserves right to terminate occupancy immediately.

7. Trailer & Equipment Rental Risk Disclosure

Trailer and equipment rentals involve inherent risks.

Client accepts responsibility for:

  • Proper towing
  • Vehicle compatibility
  • Licensing
  • Secure loading
  • Safe operation
  • Insurance compliance

Client acknowledges:

Improper use may cause:

  • Property damage
  • Injury
  • Death
  • Mechanical failure

Company does not supervise use.

Equipment rented “AS IS.”

Client assumes all operational risk.

8. Transportation & Logistics Disclaimer

M&J Aguirre Inc. may provide coordination or logistical support.

Unless specifically contracted:

Company is not acting as:

  • Common carrier
  • Freight broker
  • Licensed transportation carrier
  • Shipping guarantor

Transit timing may vary.

Company not responsible for:

  • Traffic
  • Delays
  • Mechanical issues
  • Weather
  • Vendor performance
  • Third-party failures

No delivery date guaranteed.

9. Hydrodipping / Custom Work Disclaimer

Hydrodipping and custom modification work is artistic and technical.

Client acknowledges:

  • Results vary
  • Colors may differ
  • Finishes are not identical
  • Wear patterns vary
  • Manufacturer warranties may be affected

Custom work:

  • Non-refundable once started
  • Subject to material limitations
  • Performed to commercially reasonable standards

Company does not guarantee:

  • Exact color match
  • Factory finish equivalence
  • Permanent wear resistance

10. Vehicle, Trailer & Electrical Work Disclaimer

Mechanical and electrical modifications carry risks.

Client assumes responsibility for:

  • Vehicle compatibility
  • Manufacturer limitations
  • Post-install maintenance
  • Proper use

Company not responsible for:

  • Existing defects
  • Hidden damage
  • Pre-existing issues
  • Manufacturer design limitations

Client encouraged to maintain independent insurance.

11. Consulting & Advisory Services Disclosure

Consulting services are educational and advisory.

Company does not guarantee:

  • Business success
  • Revenue
  • Licensing approval
  • Regulatory approval
  • Financial outcomes
  • Tax outcomes
  • Contractor performance

Client responsible for:

  • Independent due diligence
  • Professional advice
  • Legal review
  • Tax review
  • Licensing verification

No professional relationship with attorneys, CPAs, engineers, or regulators is created unless separately contracted.

12. Contractor & Vendor Coordination Disclaimer

Company may recommend or coordinate vendors.

Company is not liable for:

  • Third-party workmanship
  • Vendor disputes
  • Contractor negligence
  • Delays
  • Licensing issues
  • Insurance failures

Client contracts independently with third parties.

13. Assumption of Risk

Client acknowledges that certain services involve:

  • Physical risk
  • Mechanical risk
  • Travel risk
  • Recreational risk
  • Property risk

Participation is voluntary.

Client accepts inherent risks.

14. Limitation of Liability

To maximum extent allowed by law:

M&J Aguirre Inc., its owners, officers, contractors, agents, affiliates, and representatives shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Lost income
  • Lost opportunity
  • Emotional distress
  • Property loss
  • Travel disruption
  • Personal injury arising from misuse or third-party activity

Maximum liability limited to amount paid for services.

15. Indemnification

Client agrees to defend, indemnify, and hold harmless M&J Aguirre Inc. from claims arising from:

  • Misuse
  • Negligence
  • Rule violations
  • Third-party actions
  • Unsafe operation
  • Property misuse

Including:

  • Legal fees
  • Claims
  • Damages
  • Investigations

16. Insurance Disclosure

Client responsible for maintaining appropriate:

  • Auto insurance
  • Trailer insurance
  • Property insurance
  • Travel insurance
  • Liability insurance
  • Commercial coverage where applicable

Company insurance does not automatically extend to client property or activities.

17. Force Majeure

Company not liable for delay or cancellation caused by:

  • Weather
  • Fire
  • Flood
  • Natural disaster
  • Utility failure
  • Pandemic
  • Labor shortage
  • Government action
  • Civil unrest
  • Transportation disruption
  • Circumstances beyond reasonable control

18. Photography & Marketing Release

Unless prohibited in writing, Company may use:

  • Non-identifying photos
  • Project images
  • Finished work
  • Property images

For marketing and portfolio purposes.

No confidential information disclosed.

19. Website & Digital Information Disclaimer

Website content is:

  • Informational only
  • Subject to revision
  • Not contractual

Errors may occur.

Company not liable for:

  • Outdated information
  • Typographical errors
  • Third-party links
  • Temporary outages

20. Governing Law

These Terms governed by applicable laws of:

  • California
  • Arizona
  • Or jurisdiction of service performance

Venue determined by Company where legally permissible.

21. Severability

If any provision deemed unenforceable:

Remaining Terms remain effective.

22. Entire Agreement

These Terms, together with signed agreements and invoices, constitute the entire agreement.

Verbal statements do not modify written agreements.

By booking, renting, purchasing, or engaging services from M&J Aguirre Inc., Client acknowledges they have read, understood, and voluntarily agreed to these Terms and Conditions.

Return and Refund Policy

Return, Refund & Cancellation Policy

Effective Date: June 3, 2026

At M&J Aguirre Inc., we value professionalism, transparency, and customer satisfaction. Because our company provides a variety of services, rentals, consulting, hospitality, and custom work, refund and cancellation policies vary depending upon the service booked. Please review the following carefully.

By purchasing, booking, or reserving services with M&J Aguirre Inc., Client agrees to the following policies.

1. General Refund Policy

Refund eligibility depends on:

  • Service type
  • Timing of cancellation
  • Work completed
  • Materials purchased
  • Reservation commitments
  • Vendor obligations
  • Customization involved

Refunds are not automatic and are evaluated according to the policies below.

Approved refunds may take 5–14 business days to process depending on payment method and financial institution.

2. Vacation Rental Cancellation & Refund Policy 🏡

Because vacation rentals reserve exclusive dates and limit availability to other guests, the following policy applies:

Standard Reservations

30+ Days Before Arrival

  • Eligible for refund of amounts paid
  • Less processing fees and non-refundable expenses

15–29 Days Before Arrival

  • Partial refund may be issued
  • Deposit may be retained

14 Days or Less

  • Generally non-refundable

Holiday, Event & Peak Season Bookings

Including but not limited to:

  • Holidays
  • Special events
  • Lake Havasu peak weekends
  • Large event periods

May be:

  • Fully non-refundable
  • Subject to higher deposit requirements

No refunds for:

  • Weather
  • Personal schedule changes
  • Travel delays
  • Early departures
  • Guest dissatisfaction unrelated to material property defects

Travel insurance is strongly encouraged.

3. Early Departure Policy

If guest chooses to leave early:

  • Unused nights are generally non-refundable
  • No refund for shortened stays

Exceptions may be considered at Company discretion.

4. Trailer & Equipment Rental Refund Policy 🚛

Because rental inventory is reserved specifically for Client:

Cancellation Terms

72+ Hours Prior

  • Eligible for refund less administrative fees

24–72 Hours Prior

  • Partial refund possible

Under 24 Hours

  • Deposit may be forfeited

No-Show Policy

Failure to pick up or accept equipment may result in:

  • Full rental charge
  • Deposit forfeiture

5. Equipment Condition & Damage Policy

All rental equipment is inspected prior to release.

Client responsible for:

  • Damage
  • Loss
  • Theft
  • Excessive wear
  • Missing components

Refunds will not be issued for damage caused by:

  • Misuse
  • Improper towing
  • Negligence
  • Unauthorized modification

Security deposits may be withheld.

Repair costs may exceed deposits.

6. Hydrodipping & Custom Work Refund Policy 🎨

Custom and specialty work involves:

  • Labor
  • Design preparation
  • Materials
  • Specialized production

Accordingly:

Deposits

Custom deposits are generally:

  • Non-refundable
  • Applied toward project cost

After Production Begins

Once work has started:

  • No refunds
  • No returns
  • No exchanges

Due to the customized nature of the work.

Company will make commercially reasonable efforts to address workmanship concerns.

However:

Minor variation is normal and expected.

No guarantee of:

  • Exact color match
  • Identical pattern placement
  • Factory-equivalent finish

7. Electrical, Modification & Installation Services ⚡

Labor and installation appointments reserve technician time.

Cancellation

48+ Hours Notice

  • May be rescheduled

Less Than 48 Hours

  • Deposit or service fee may be retained

Completed Labor

Labor already performed is:

  • Earned upon completion
  • Non-refundable

Parts ordered specifically for Client:

  • Non-returnable unless supplier accepts return

Restocking fees may apply.

8. Consulting & Professional Services Refund Policy 📋

Consulting, planning, and advisory services reserve Company expertise and scheduling.

Consultation Fees

Once consultation occurs:

  • Fees are earned
  • Non-refundable

Project Deposits

Deposits may cover:

  • Research
  • Planning
  • Scheduling
  • Administrative preparation

These expenses may be:

  • Partially refundable
  • Non-refundable depending on work completed

No guarantee is made regarding:

  • Business outcomes
  • Licensing
  • Revenue
  • Project success
  • Financial results

9. Contractor Coordination & Project Support Refund Policy 🔧

Project management and coordination involve substantial planning.

Refunds may be reduced by:

  • Time spent
  • Vendor coordination
  • Site visits
  • Administrative costs
  • Contract commitments

Third-party contractor disputes are governed separately.

Company is not responsible for:

  • Vendor refund decisions
  • Contractor performance

10. Hospitality & Event Services 🌴

Event and concierge services involve advanced preparation.

Including:

  • Decor

  • Setup labor
  • Reservation commitments

Accordingly:

Deposits are generally:

  • Non-refundable
  • Transferable only with Company approval

Cancellations close to event dates may result in:

  • Full forfeiture

11. Product Returns (Retail / Merchandise)

If merchandise or retail items are offered:

Eligible Returns

  • Unused
  • Unopened
  • Original condition
  • Returned within 14 days

Return approval required.

Client responsible for shipping unless Company error occurred.

Non-Returnable Items

  • Custom products
  • Personalized goods
  • Used items
  • Opened items
  • Clearance items
  • Hygiene-related products

12. Refund Method

Approved refunds issued through:

  • Original payment method

  • Company-approved alternative

Company may deduct:

  • Processing fees

  • Damage charges
  • Restocking fees

13. Chargeback Policy

Clients agree to first contact Company to resolve concerns.

Fraudulent or improper chargebacks may result in:

  • Collection activity
  • Legal action
  • Recovery of fees and damages

14. Company Right to Refuse Refund

M&J Aguirre Inc. reserves the right to deny refunds where:

  • Terms violated
  • Misrepresentation occurred
  • Services fully rendered
  • Damage present
  • Fraud suspected
  • Safety concerns exist

15. Policy Updates

Company reserves right to modify this policy at any time.

Customer Acknowledgment

By booking, renting, purchasing, or engaging services with M&J Aguirre Inc., Client acknowledges and accepts this Return, Refund, and Cancellation Policy.
